Facts of the Case:
Supreme
Court of India dismissed the writ petition “Association of Registration Plates
Vs. Union of India (2005 1 SCC 679) respect to challenge made to the statutory
order of the Government of India to introduce new scheme regarding issuance and
fixation of High Security Number Plate and the Court issue direction for
appropriate implementation of the order of the Central Government.
Issue of the Case:
The
State of Haryana has failed to comply with the direction of the Supreme Court
and implementation of the scheme. And despite repeated order, fails to take
necessary action in compliance with the law.
Judgement of the
Supreme Court:
Due to non-compliance to the courts order the Supreme Court of India hold guilty the Secretary, Transport and Commission, State Road Transport Authority of the State of Haryana and punished him
a) Pay fine Rs. 2000/- and in default, they shall be liable for simple imprisonment for a period of 15 days.
b) The Court impose exemplary cost of Rs. 50000/- on the Stat of Haryana be recovered from the salaries of the concerned officials of the state government.
