    श्री. शौरी यांच्याविरुद्ध अवमानाची कारवाई भाजप नेते सुब्रमण्यम स्वामी यांनी दाखल केलेल्या याचिकेवर सुरू करण्यात आली होती, ज्यांनी 13 ऑगस्ट 1990 रोजी एका राष्ट्रीय दैनिकात न्यायमूर्ती कुलदीप सिंग यांच्या अध्यक्षतेखालील एक सदस्यीय आयोगाने हे संपादकीय सादर केले होते. सर्वोच्च न्यायालयानेही स्वत:हून दखल घेतली.

    सर्वोच्च न्यायालयाचे तत्कालीन विद्यमान न्यायाधीश न्यायमूर्ती कुलदीप सिंग यांची कर्नाटकचे माजी मुख्यमंत्री हेगडे यांच्या कथित चूका आणि आयोगांच्या चौकशीसाठी कमिशन ऑफ इन्क्वायरी कायदा, 1952 अंतर्गत चौकशी आयोगाचे अध्यक्ष म्हणून नियुक्ती करण्यात आली होती. आयोगाने 22 जून 1990 रोजी आपला अहवाल सादर केला.

खंडपीठाने म्हटले 

    “1952 कायद्यांतर्गत स्थापन करण्यात आलेला आयोग हा एक तथ्य शोधणारी संस्था आहे ज्यामुळे सरकारला पुढील कारवाईचा योग्य मार्ग ठरवता येईल. अशा आयोगाला पक्षकारांच्या अधिकारांवर निर्णय देण्याची आवश्यकता नाही आणि त्यांचे कोणतेही न्यायिक कार्य नाही. सरकार त्यांच्या शिफारसी स्वीकारण्यास किंवा त्यांच्या निष्कर्षांवर कृती करण्यास बांधील नाही.

    “कमिशनने स्वीकारलेली प्रक्रिया कायदेशीर स्वरूपाची आहे आणि त्याला शपथ घेण्याचा अधिकार आहे ही वस्तुस्थिती न्यायालयाचा दर्जा देणार नाही. त्यामुळे  1952 च्या कायद्यांतर्गत नेमण्यात आलेला आयोग हा न्यायालयाचा अवमान कायद्याच्या उद्देशाने न्यायालय नाही, जरी ते सर्वोच्च न्यायालयाच्या विद्यमान न्यायाधीशांच्या अध्यक्षतेखाली असले तरी,” .

    “1952 च्या कायद्यांतर्गत नियुक्त केलेल्या आयोगाची कार्ये न्यायालयीन कार्ये किंवा न्यायिक शक्ती पार पाडणार्‍या मंडळासारखी नसतात याबद्दल आमच्या मनात कोणतीही शंका नाही. आमच्या दृष्टीने 1952 च्या कायद्यांतर्गत नेमलेले आयोग हे न्यायालय नाही आणि आयोगाने चौकशी करणे किंवा तथ्ये निश्चित करणे हे न्यायिक स्वरूपाचे नाही,”

    न्यायमूर्ती अनिल आर दवे, न्यायमूर्ती एस जे मुखोपाध्याय, दीपक मिश्रा, शिवा कीर्ती सिंग यांचा समावेश असलेल्या खंडपीठाने असेही मत मांडले की अवमान प्रकरणातील सत्य हे सार्वजनिक हिताचे असेल तर ते बचाव आहे आणि बचावाची विनंती करणे योग्य असल्याचे सांगितले.

    सर्वोच्च न्यायालयाने ज्येष्ठ पत्रकार अरुण शौरी यांच्याविरुद्ध 1990 मध्ये कर्नाटकचे माजी मुख्यमंत्री रामकृष्ण हेगडे यांच्या विरोधात वगळण्याच्या आणि आयोगाच्या चौकशीसाठी नेमलेल्या आयोगाचे प्रमुख असलेल्या तत्कालीन न्यायाधीशांविरुद्ध 1990 मध्ये लिहिल्याबद्दल 24 वर्षे जुनी अवमानाची कारवाई रद्द केली.

    सरन्यायाधीश आर एम लोढा यांच्या अध्यक्षतेखालील पाच न्यायाधीशांच्या खंडपीठाने असे मत मांडले की सरकारने स्थापन केलेला चौकशी आयोग हा या न्यायालयाचा विस्तारित शाखा बनत नाही कारण त्याचे अध्यक्ष न्यायाधीश आहेत.

मेरठ मध्ये सिताराम हॉस्टेल होतं. तिथे सुनील कुमार, पुनीत कुमार गिरी, सुधीर कुमार हे व इतर विद्यार्थी रहात होते. सुनील कुमार, पुनीत कुमार गिरी, सुधीर कुमार हे विद्यार्थी २३ मे २००८ रोजी  अचानक गायब झाले. ते कुठेच सापडत नव्हते सुनील कुमारच्या भावाने, अनिल कुमार यांनी  पोलिस स्टेशन मध्ये FIR दिली. २२ मे च्या रात्रीपासून सापडत ते नव्हते म्हणून २३ मे ला FIR दिली FIR दिल्याच्या दुसऱ्या दिवशी पोलिसांना त्या तिघांचे मृतदेह  सापडले. त्यानंतर अज्ञात व्यक्तीवर फौजदारी गुन्हा नोंदविण्यात आला. काही गुन्हेगारांना पकडण्यात आले. त्या गुन्हेगारांनी जामिनासाठी  साठी जिल्हा न्यायालय मेरठ मध्ये अर्ज केला . परंतु कोर्टाने ते नामंजूर केले. त्यांनी उच्च न्यायालयात जामिनासाठी अर्ज केला.

यादरम्यान बालकिशन गिरी हे एक वकील होते, पुनीत कुमार गिरी हा त्यांचा पुतण्या होता. १४ ऑगस्ट २००९ रोजी त्यांनी अलाहाबाद उच्च न्यायालयात अर्ज दाखल केला.  त्यात त्यांनी लिहिले की सगळे गुन्हेगार हे गुन्हेगारी पार्श्वभूमीचे आहेत आणि त्यांच्या बेकायदेशीर कामामुळे  त्यांनी संपत्ती कमावली आहे. स्थानिक आमदार आणि माजी आमदार यांच्याशी जवळचे संबंध आहेत. हायकोर्टामध्ये त्यांचे चांगले संबंध आहेत.  जे. एस. के. जैन, जे. व्ही.  वर्मा, जे.एस.सी.  निगम  यांची नावे त्यात होती. त्यांना भीती होती की या लोकांना जमीन मंजूर होईल आणि न्याय मिळणार नाही.

उच्च न्यायालयाने  कारणे दाखवा नोटीस  पाठवली की , तुमच्याविरुद्ध तुमच्या विरुद्ध  अवमान खटला का दाखल करू नये? 

त्यानंतर    २१.११.२००९ रोजी अपीलकर्त्याने बिनशर्त माफीनामा सादर केला आणि सांगितले की, मेरठ जिल्ह्यातील वकिलांनी आपली दिशाभूल केली होती आणि आपल्या पुतण्याची हत्या झाली असल्याने तो प्रचंड मानसिक तणावात होता म्हणून त्याने अर्ज पाठविला होता. 

अपीलकर्त्याने उच्च न्यायालयाच्या ३ न्यायमूर्तींविरुद्ध केलेले आरोप अतिशय गंभीर, निंदनीय आणि कायद्याच्या वैभवाला आणि न्यायालयाच्या प्रतिष्ठेला धक्का लावण्यासाठी पुरेसे आहेत आणि तेही कोणत्याही आधाराशिवाय आहेत. अपीलकर्ता प्रॅक्टिस करणारे वकील आहेत. इतर वकिलांनी आपली दिशाभूल केली आहे, अशी त्यांनी घेतलेली विनंती म्हणजे विचारोत्तर आहे.

FACTS:

There was Sitaram Hostel in Meerut. Sunil Kumar, Puneet Kumar Giri, Sudhir Kumar and other students were staying there. Students Sunil Kumar, Puneet Kumar Giri, Sudhir Kumar disappeared suddenly on 23 May 2008. Sunil Kumar's brother, Anil Kumar filed an FIR   at the police station. As the students were missing since 22 May 2008 night, an FIR was filed on 23 May 2008.

The next day of an FIR the police found 3 dead bodies. A criminal case was registered against an unknown person. Some criminals were caught. Those criminals applied for bail in District Court Meerut. But the court rejected it further they applied for bail in the High Court. 

Meanwhile Balkishan Giri was a lawyer, Puneet Kumar Giri was his nephew. On August 14, 2009, he filed an application in the Allahabad High Court.  He wrote that all the criminals have a criminal background and have earned wealth through their illegal means. They have close ties with local MLAs and former MLAs. He has good relations in the High Court.  J. S. K. Jain, J. V.  Verma, J.S.C. Nigam 's names were in it. He was afraid they may get bail instead the justice. 

The High Court sent a show cause notice, Why the contempt case should not be initiated against you?  

Thereafter, on 21 Nov 2009, the appellant tendered an unconditional apology stating that he had been misled by the Meerut district lawyers and that he had sent the application as he was under great mental stress due to the murder of his nephew.

The allegations leveled by the appellant against the 3 Judges of the High Court are very serious, scandalous and sufficient to detract from the dignity of the law and the reputation of the Court and are also without any basis. The appellant is a practicing advocate. His plea that he has been misled by other lawyers is an afterthought. 

JUDGEMENT:

    In view of the judgment passed today in connected Criminal Appeal No. 555 of 2010, this appeal is dismissed. However, the fine of Rs.20,000/- imposed on the appellant by the High Court by way of impugned judgment and order, is reduced to Rs.2,000/- and is directed to deposit the said fine forthwith.

     The appellant must surrender to serve out the sentence forthwith, failing which, the learned Chief Judicial Magistrate, Meerut, would secure his custody and send him to jail to serve out the sentence. A copy of the order be sent to the learned Chief Judicial Magistrate, Meerut, for information and compliance.

    या खटल्यातील, प्रतिवादी क्रमांक १, श्री पी. शिवशंकर, कायदा, न्याय आणि कंपनी व्यवहार मंत्री होते, यांनी हैदराबादच्या बार कौन्सिलच्या बैठकीत भाषण केले.

 

    याचिकाकर्ते पी. एन. दुडा जे वकील होते यांनी एक याचिका दाखल केली, असा आरोप करण्यात आला होता की त्या भाषणात उत्तरदात्याने सर्वोच्च न्यायालयाच्या प्रतिष्ठेला अपमानास्पद विधाने केली आहेत, न्यायालयाचे श्रेय श्रीमंत लोकांबद्दल पक्षपातीपणाचे आहे आणि अत्यंत संयमी आणि अशोभनीय भाषा वापरणे आहे आणि भाषणात न्यायालय न्यायाधीश आणि न्यायालयाच्या कामकाजाच्या बाबतीत अपशब्द वापरण्यात आले आहेत. कायद्याच्या कलम 15 (1), (अ) आणि (ब) अंतर्गत अवमान सुरू करण्यासाठीचा अर्ज (1) आणि नियम 3 (a), (b) आणि (c) च्या स्पष्टीकरणासह वाचला आहे. , 1975 करण्यात आली, जिथे श्री पी. शिवशंकर, अॅटर्नी जनरल आणि सॉलिसिटर जनरल यांना पक्षकार करण्यात आले.

    या याचिकेत श्री दुडा यांनी ऍटर्नी जनरल यांना पत्र लिहून श्री पी. शिव शंकर यांच्या विरोधात अवमानाची कारवाई करण्यास संमती मागितली होती. या पत्राची प्रत भारताचे सॉलिसिटर जनरल यांनाही पाठवण्यात आली होती. संमती मागताना, याचिकाकर्त्याने असेही नमूद केले होते की कायदा मंत्र्यांवर खटला चालवण्यास संमती देण्यास ऍटर्नी जनरलला लाज वाटू शकते आणि हे आरोप पाहता, ऍटर्नी जनरलला असे वाटले की ऍटर्नी जनरलच्या कार्यालयाची विश्वासार्हता आणि अधिकार आहे. कमी केले आणि म्हणून खटला चालवण्यास नकार दिला नाही किंवा मंजूरी दिली नाही. अॅटर्नी जनरल आणि सॉलिसिटर जनरल यांच्या संमतीशिवाय प्रतिवादीविरुद्ध अवमानाची कारवाई सुरू करण्यासाठी याचिकाकर्ता न्यायालयात जाऊ शकत नाही, असे न्यायालयाने नमूद केले.

    प्रतिवादी क्रमांक 1, न्यायालयाने जारी केलेल्या नोटीसला उत्तर म्हणून प्रतिज्ञापत्र दाखल केले. त्यांनी विधानमंडळ, कार्यपालिका आणि न्यायपालिका यांच्या उत्तरदायित्व या विषयावर भाषण केले होते आणि तिन्ही अवयवांची जबाबदारी आणि त्यांचे सैद्धांतिक परिणाम यावर भाष्य केले होते, असे त्यांनी नमूद केले. सर्वोच्च न्यायालयाच्या तुलनेत कोणत्याही संस्थेचा किंवा तिच्या कार्यकर्त्याचा अनादर करण्याचा माझा हेतू नव्हता, असेही त्यांनी स्पष्ट केले.अटर्नी जनरल किंवा सॉलिसिटर जनरल यांच्या संमतीशिवाय अवमान याचिका राखता येणार नाही, असे पुढे नमूद करण्यात आले.

    दरम्यान, श्री आर.एन.त्रिवेदी, अधिवक्ता, यांनी एक पक्षकार म्हणून आरोप लावण्याच्या हक्काचा दावा करणारा अर्ज दाखल केला, त्यात नमूद केले की, अटर्नी जनरल आणि सॉलिसिटर जनरल यांना अवमान याचिकेत पक्षकार बनवायला नको होते आणि अधिकारक्षेत्रातील कथित  अटॉर्नी-जनरल आणि सॉलिसिटर जनरल यांनी कलम 2(c) च्या अर्थामध्ये अवमान स्थापन केला नव्हता.

    न्यायालयाने अवमानाची कार्यवाही सुरू करण्यास नकार दिला, याचिका फेटाळून लावली आणि श्री आर.एन.त्रिवेदी यांनी दाखल केलेला अर्ज निकाली काढला.

 

    असे नमूद केले आहे की न्यायप्रणाली किंवा न्यायाधीशांबद्दल कोणतीही टीका जी न्यायप्रशासनात अडथळे आणते किंवा न्यायाधीशांच्या वस्तुनिष्ठ दृष्टिकोनावरील विश्वास कमी करते आणि न्याय प्रशासनाची थट्टा करते, ते रोखले पाहिजे. न्यायप्रशासनावरील विश्वास हा एक स्तंभ आहे ज्याद्वारे लोकशाही संस्था कार्य करते आणि टिकते.

FACTS:

In this case, respondent No. 1, Shri P. Shiv Shankar, Minister of Law, Justice and Company Affairs, addressed the Hyderabad Bar Council meeting.

Petitioner PN Duda J, filed a petition alleging that in speech the respondent had made statements defamatory to the dignity of the Supreme Court, attributed the Court to favoritism towards rich people and used very intemperate and indecent language and in the speech had derogatory words to the Court Judges and court proceedings. 

An application for initiation of contempt under Section 15 (1), (a) and (b) of the Act read with Explanation (1) and Rule 3 (a), (b) and (c), where Shri P. Shivshankar made, Attorney General and Solicitor General as parties.

PN Duda wrote a letter to the Attorney General for Consent to take contempt action against P Shiv Shankar. A copy of this letter was also sent to the Solicitor General of India. While seeking consent, the petitioner had also mentioned that the case against the Law Minister, the Attorney General may have been embarrassed to consent to the operation and given these allegations. The Attorney General felt that the Attorney General's office had credibility and authority, therefore neither declined nor sanctioned prosecution.

The court held that the petitioner cannot approach the court to initiate contempt proceedings against the respondent without the consent of the Attorney General, the Solicitor General.

       Respondent No. 1, filed an affidavit in reply to the notice issued by the Court. He stated that, he spoke about accountability of legislature, executive and judiciary and commented on the responsibility of all the three organs and their theoretical implications. He also clarified that I had no intention to disrespect any institution, or its functionaries compared to the Supreme Court. It was further stated that contempt petitions cannot be maintained without the consent of the Attorney General or the Solicitor General.

Meanwhile, Advocate RN Trivedi, filed an application claiming right to be impleaded as a party, stating that the Attorney General and Solicitor General should not have been made a party to the contempt petition and that the alleged Attorney-General and Solicitor General of jurisdiction had not constituted contempt within the meaning of Article 2(c).

 

JUDGEMENT:

The Court declined to initiate contempt proceedings, dismissed the petition and disposed of the application filed by Shri RN Trivedi.         

         It is stated that any criticism of the judiciary or judges which obstructs the administration of justice or undermines confidence in the objective view of judges and makes a mockery of the administration of justice, should be prevented. Trust in the administration of justice is one of the pillars by which a democratic institution functions and survives.

 Below is the summarized Judgement

     This petition, if treated as one filed under Section 15(1) read c. with rule 3(a) is not in proper form and, if treated as one filed under rules 3(b) and 3(c), is not maintainable as it is not filed by the Attorney General/Solicitor General or by any person with his consent.

     In either event the petitioner should not have added to the petition respondents other than the person who, according to the petitioner, is guilty of contempt of court and so their names should be deleted from the array of parties.

   In case the Attorney General/Solicitor General refuse consent or decline to act, their decision is not judicially reviewable and petitioner's remedy is to approach the Court for action under rule 3(a).

  The Attorney General/Solicitor General acted properly in declining to deal with the petitioner's application either way

   Considering the petition as nothing more than information under rule 3(a) on which this Court may or may not take Suo-Motu action. 

    After hearing counsel for the alleged contemner, we think there is no need to initiate proceedings against respondent No. 1 for contempt of court. I, therefore, agree that the petition should be dismissed.

वकील चरणलाल साहू हे सुप्रीम कोर्टाचे अनुभवी वकील होते . चरणलाल साहू त्यांनी सर्वोच्च न्यायालयात मध्ये संविधानाचे कलम 32 अंतर्गत रिट याचिका दाखल केली होती.

रिट याचिकेत एका ठिकाणी त्यांनी असा आरोप केला आहे.

"अशा प्रकारे न्यायाधीशांचे कार्य हे पाश्चात्य सामान्य कायदे आणि अमेरिकन तंत्रांवर आधारित कॉकटेल आहे, कारण न्यायाधीशांचे कार्य देशाच्या सामाजिक-आर्थिक परिस्थितीनुसार अनुत्पादक आणि कालबाह्य आहे."

दुसर्‍या ठिकाणी याचिकाकर्त्याने असे म्हटले आहे की:

"सरकारच्या बेकायदेशीर कृत्यांवर नियंत्रण न ठेवता हे न्यायालय एक घटनात्मक दायित्व बनले आहे.... अशा प्रकारे ज्यांच्यासाठी संविधान अभिप्रेत आहे अशा लोकांनी आता त्याविरुद्ध तोंड फिरवले आहे, जो न्याय ही इच्छा आहे या भीतीने भ्रमनिरास आहे.

अजून एका ठिकाणी याचिकाकर्त्याने असे म्हटले आहे की हे न्यायालय मुद्द्यांवर कुंभकर्णा सारखे झोपले आहे.

सर्वोच्च न्यायालयाने निर्देशित केले..

न्यायालयाचा अवमान करण्याच्या उद्देशाने ही याचिका तयार करण्यात आली आहे आणि त्यामुळे याचिकाकर्ता प्रथमदर्शनी अवमानासाठी दोषी आहे असे सर्वोच्च न्यायालयाचे प्रथमदर्शनी मत आहे. रिट याचिका निष्काळजीपणे तयार करण्यात आली आहे. अनेक ठिकाणी निवेदने निरर्थक आहेत. इतर अनेक ठिकाणी ते परस्परविरोधी आहेत. आरोप अनाठायी आहेत आणि त्याचा आकार वाढवण्यासाठी याचिकेत अनेक असंबद्ध तथ्ये मांडण्यात आली आहेत.

याचिकाकर्त्याने संस्थेवर चिखलफेक करण्याच्या हेतूने याचिका बनवण्यात आलेली आहे. याचिका काढताना याचिकाकर्त्याने स्वतःला एकच निष्कलंक व्यक्ती आणि सामाजिक संस्थांसह इतर सर्वजण दोषी मानले आहेत. या न्यायालयात प्रॅक्टिस करणाऱ्या आणि अनुभव असलेल्या वकिलाने अशा बेजबाबदारपणे वागणे याचे आम्हाला आश्चर्य वाटते. त्यानुसार रिट याचिका फेटाळतो.

रिट याचिकेमुळे न्यायालयाची सर्वोच्च न्यायिक संस्था म्हणून असलेली प्रतिष्ठा कमी होण्याची शक्यता आहे. जनहित याचिकेत याचिकाकर्त्याने आत्मसंयमाची मर्यादा नक्कीच ओलांडली आहे. त्यामुळे रजिस्ट्रीला अवमानासाठी योग्य कार्यवाही करण्याचे निर्देश देतो आणि याचिकाकर्त्याला 9 नोव्हेंबर, 1987 रोजी त्याला वैयक्तिकरित्या कारणे दाखविण्याचे आवाहन करून न्यायालयाचा अवमान कायद्यांतर्गत त्याच्यावर कारवाई का केली जाऊ नये यासाठी नोटीस जारी केली जाते.

FACTS:

Lawyer Charanlal Sahu was an experienced Supreme Court lawyer.

Charanlal Sahu had filed a writ petition under Article 32 of the Constitution in the Supreme Court.

He has alleged this at one place in the writ petition. "Thus the function of the judge is a cocktail based on Western common law and American techniques, because the function of the judge is unproductive and outdated according to the socio-economic conditions of the country."

     The petitioner states that, "This court has become a constitutional liability without checking the illegal acts of the government, thus the people for whom the Constitution is intended have now turned against it, who are disillusioned with the fear that justice is the will."

     At another place the petitioner has said that this Court is sleeping like Kumbhakarna on the issues.

 JUDGEMENT:

 The Supreme Court prima facie opined that the petition is framed with the intention of contempt of court and therefore the petitioner is guilty of contempt. Writ Petition is negligently framed. In many places the statements are meaningless. In many other places they are contradictory. The allegations are frivolous, and many irrelevant facts are presented in the petition to increase its size.

     The petition has been made with the intention of the petitioner to cast aspersions on the institution. While withdrawing the petition, the petitioner has held himself as one blameless person and all others including the social institutions are guilty. We are surprised that a practicing and experienced lawyer in this court should behave so irresponsibly. Accordingly, the writ petition is dismissed.

     The writ petition is likely to tarnish the reputation of the court as the highest judicial institution. The petitioner has certainly crossed the limit of self-restraint in a Public Interest Litigation. It therefore directs the Registry to take appropriate proceedings for contempt and a notice is issued to the petitioner on 09 November 1987 calling upon him personally to show cause why he should not be prosecuted under the Contempt of Court Act.

न्यायालयाच्या अवमानासाठी उच्च न्यायालयाने दोषी ठरवले आणि शिक्षा सुनावणाऱ्या वकिलाने सर्वोच्च न्यायालयाकडे दाद मागितली, उच्च न्यायालयाने दोषी ठरविण्यास पुरेसे आहे की नाही, सर्वोच्च न्यायालयाच्या निर्देशानुसार, न्यायाधीशांकडे लेखी माफी मागितली. 

 

तथ्ये:

1. अॅड. एल.डी. जेलवाल यांच्या क्लायंटला एल.डी. विशेष न्यायाधीश, डेहराडून.

2. अधिवक्ता Ld समोर हजर राहणे आवश्यक होते. भ्रष्टाचार प्रतिबंधक कायद्याच्या 5(2) अन्वये आरोपी असलेल्या त्याच्या अशिलाला ठोठावल्या जाणाऱ्या शिक्षेच्या प्रश्नावर आपले म्हणणे मांडण्यासाठी विशेष न्यायाधीश.

3. वकील शर्ट आणि ट्राउझरमध्ये दिसला ज्याने नियमाकडे दुर्लक्ष करून व्यावसायिक क्षमतेत उपस्थित असताना कोर्टाच्या पोशाखात हजर राहणे आवश्यक आहे.

4. एलडी. विशेष न्यायाधीशांनी त्याला कोर्टातून बाहेर पडण्यास सांगितले आणि योग्य कोर्टाच्या पोशाखात परत या.

5. Ld कडून त्याच्या सूचनेमुळे. न्यायाधीश, वकील नाराज होऊन कोर्टातून निघून गेले 

6. आरोपीच्या वतीने काही अन्य वकील त्याच्या केसवर हजर झाले.

7. एलडी. न्यायाधीशांनी खटल्याचा निकाल दिला आणि आरोपीला (म्हणजे अॅड. एल. डी. जायकवाल यांचे ग्राहक) 4 वर्षे सश्रम कारावासाची शिक्षा सुनावली.

8. कायद्यातील तरतुदीनुसार, अॅड एल.डी. जायकवाल आणि त्यांच्या अशिलाला विशेष न्यायालयाच्या आदेशाविरुद्ध उच्च न्यायालयात अपील करण्याचा पर्याय होता.

9. यावेळी, अॅड. एल.डी. जायकवाल, जे दीर्घकाळ टिकणारे ज्येष्ठ वकील होते आणि अपरिपक्व वकिल होते, त्यांनी विशेष न्यायाधीशांना लेखी अर्ज केला होता, ज्यामध्ये ते न्यायाधीश “भ्रष्ट न्यायाधीश” होते आणि ते “भ्रष्ट न्यायाधीश” होते, असा ठपका ठेवत खोडसाळ भाषेत लिहिले होते. न्यायाचे आसन दूषित करणे"

 

समस्या:

न्यायाधीशाने आरोप/प्रत्यारोप करून आणि न्यायाधीशाला न्यायालयाचा अवमान म्हणून धमकावून प्रकरण निकाली काढल्यानंतर वकिलाद्वारे असा अर्ज करायचा का?

 

अलाहाबाद उच्च न्यायालयाचा निर्णय:

         अलाहाबाद उच्च न्यायालयाच्या वकिलाविरुद्ध सुरू केलेल्या न्यायालयाच्या अवमानाच्या कारवाईच्या आधारे वकिलाला न्यायालयाचा अवमान अधिनियम, 1971 च्या कलम 2 सी (i) अंतर्गत फौजदारी अवमान केल्याबद्दल दोषी आढळले.

             उच्च न्यायालयाने 500 रुपये दंडासह 1 आठवड्याच्या साध्या कारावासाची शिक्षा ठोठावली. 

 

एलडी जायकवाल यांचे सर्वोच्च न्यायालयात अपील:

             अलाहाबाद उच्च न्यायालयाच्या निर्णयामुळे नाराज होऊन अॅड एलडी जायकवाल यांनी सर्वोच्च न्यायालयात दाद मागितली.

 

सर्वोच्च न्यायालयाचा निर्णय / निकाल

             अपीलार्थी वकिलांनी उच्च न्यायालयात माफी मागितली नाही, परंतु आपले मानसिक संतुलन गमावले असल्याचे सांगत सर्वोच्च न्यायालयासमोर आपली खंत व्यक्त केली.

सर्वोच्च न्यायालयाने त्याची सुनावणी करण्यास टाळाटाळ केली. त्यानंतर अपीलकर्त्याने 3 आठवड्यांच्या कालावधीसाठी प्रार्थना केली जेणेकरून तो Ld ला माफी मागू शकेल. विशेष न्यायालयाचे न्यायाधीश व न्यायालयाने त्याला मान्यता दिली.

 

             यानंतर अपिलार्थी एल.डी.समोर हजर झाले. विशेष न्यायाधीश आणि "माननीय सर्वोच्च न्यायालयाच्या निर्देशानुसार तो माफी मागत आहे" असे सांगून लेखी माफीनामा सादर केला. परिस्थितीने स्पष्टपणे दर्शवले की तो दिलगीर नव्हता, तो फक्त कागदी माफी होती. खेदाची भावना हृदयातून नव्हे तर लेखणीतून आली. "सॉरी म्हणणे" आणि खेद वाटणे एक गोष्ट आहे"

             “सर्वोच्च न्यायालयाचे असे मत आहे की उच्च न्यायालयाला ठोस शिक्षा ठोठावण्यात न्याय्य आहे आणि ठोठावण्यात आलेली शिक्षा जास्त किंवा प्रमाणाबाहेर आहे असे म्हणता येणार नाही. त्यानुसार अपील फेटाळले जाते”

Advocate making written application couched in scurrilous language-Imputation-Judge “A Corrupt Judge” and “contaminating the seat of justice”.

High Court convicting and sentencing advocate for contempt of Court appeal to Supreme Court Written apology tendered to Judge 'as directed by the Supreme Court', whether sufficient to set aside conviction by High Court. 

 

Facts:

1.          Adv L D Jailwal’s Client was convicted by Ld. Special Judge, Dehradun.

2.          Advocate was required to appear before Ld. Special judge to make his submission on question of sentence to be imposed on his client who was accused u/s 5(2) of Prevention of corruption act.

3.          Advocate appeared in shirt and trouser in disregard to rule which require him to appear in court attire while appearing in professional capacity.

4.          Ld. Special judge told him to leave the court and come back in proper court attire.

5.          Because of his instruction from Ld. Judge, Advocate got annoyed and left the court 

6.          Some other advocate appeared on his case on behalf of accused.

7.          Ld. Judge delivered his judgement on the case and imposed sentence of 4 years rigorous imprisonment on the accused (i.e. Adv. L D Jaikwal’s Client)

8.          As per provision under law, Adv L D Jaikwal and his client had an option to appeal to high court against the order of special court.

9.          At this point, Adv L D Jaikwal, who was senior advocate of long standing and no and immature advocate, made a written application to the special judge worded in scurrilous language making imputation that the judge was “Corrupt Judge” and that he was “contaminating the seat of justice”

 

Issue:

Whether making such application by and advocate after the matter is disposed by a judge making imputation/charges and threatening a judge amount to contempt of Court?

 

Decision of Allahabad High Court:

         Based on contempt of court proceedings initiated against the Advocate Allahabad High Court found the advocate guilty of having committed Criminal Contempt under section 2 c (i) of the Contempt of Court Act,1971

             High Court Imposed the sentence of 1 week of simple imprisonment with fine of Rs.500. 

 

Appeal by L D Jaikwal in Supreme Court:

             Aggrieved by the decision of Allahabad high court, Adv L.D Jaikwal made an appeal to Supreme court.

 

Decision of Supreme Court/ Judgement

             Appellant Advocate had not tendered an apology to high court but expressed his sorrow before supreme court saying that he had lost his mental balance.

Supreme court was reluctant to hear him. Then appellant prayed for the time of 3 weeks so that he can rendered an apology to the Ld. Special Court Judge and court accepted and allowed him.

 

             After this appellant appeared before Ld. Special Judge & tendered written apology stating, “He is apologizing as directed by Hon’ble Supreme Court” The circumstances clearly showed that he was not sorry, it was just a paper apology. Expression of sorry came from his pen and not from the heart. There is one thing “to say sorry” and to feel sorry”

             “Supreme Court is of the opinion that the High court was therefore justified in imposing a substantive sentence and sentence imposed cannot be said to be excessive or out of proportion. An Appeal is accordingly dismissed”
